Consent to Receive Promotional and Informational Messages

This Consent is executed separately from the Public Offer, the Platform Terms of Use, age confirmation, and consent to the processing of personal data for registration and performance of the Order.

By ticking a separate box in the interface, I act freely, of my own will and in my own interest, and express prior consent to receive advertising, as well as specific, express, informed, conscious and unambiguous consent to the processing of personal data solely for the purpose of this mailing.

1 Content and channel of messages

1.1. I agree to receive from the Operator, at the email address I provided at registration, when placing an Order, or when subscribing, messages about new events, tiers, discounts, special offers, Rich Witch platform features, surveys, and other materials promoting the Operator's services and the events available on the Platform.

1.2. This Consent covers email only. Advertising by SMS, phone, messengers, push notifications, or other channels requires a separate choice of that channel and a separately recorded consent.

1.3. Service messages about registration, security, payment, refunds, access, the rescheduling or cancellation of an Event, confirming a paid in-person meeting, and notifying a raffle entrant of their result are not a promotional subscription and are sent to the extent necessary regardless of this Consent.

2 Personal data and actions with it

2.1. For the mailing, the following may be processed: name or nickname, email address, user or Order ID, the events and tiers chosen (to determine a relevant segment), the date and source of this Consent, the revision and text of the checkbox, the IP address, user agent or another technical identifier of the action, and delivery, open, click, and opt-out statuses.

2.2. The Operator may collect, record, systematise, accumulate, store, clarify, retrieve, use, transfer (by way of provision or access) to the mailing service, anonymise, block, delete, and destroy the data listed above, by automated and non-automated means.

2.3. The password, payment data, the content of restricted material, special categories of personal data, and information of an intimate nature are not processed for the promotional mailing and are not transferred to the mailing service.

3 Mailing service

3.1. Delivery of emails is entrusted to Unisender Smart LLC (the UniSender service), OGRN 1227700213180, INN 9731091240, KPP 771501001, address: 127015, Moscow, Butyrsky municipal district, Bolshaya Novodmitrovskaya St., 23, unit 2/46. It is given only the data listed in clause 2.1, to the extent necessary for delivery, maintaining the subscription and opt-out list, and compiling statistics.

3.2. Unisender Smart LLC processes the data on the Operator's instructions. If the service is changed, the Operator updates the information in this Consent and in the Personal Data Processing Policy before transferring data to the new processor, and obtains new consent where necessary. If a foreign entity is engaged or data is transferred outside the Russian Federation, the Operator first meets the localisation and cross-border transfer requirements.

4 Term and opting out

4.1. This Consent is effective from the moment the separate box is checked until it is withdrawn. Declining to give it, or withdrawing it, does not affect registration, the conclusion and performance of the Agreement, access to purchased services, or receiving service messages.

4.2. I may opt out of advertising at any time via the "Unsubscribe" link in any promotional email, or by sending a request to support@richwitch.com from the subscribed address or stating that address. The Operator stops distributing advertising to me immediately upon receiving the opt-out.

4.3. Processing data solely for the promotional purpose stops, and such data is deleted no later than 30 days after withdrawal, unless its retention is required on another lawful basis. Minimal information about the fact of consent, its revision, its withdrawal, and the address's inclusion on the suppression list may be kept within the period of any possible claims, to confirm compliance with the opt-out and prevent re-sending.

5 Confirmation of consent

5.1. The Operator records the text and revision of the Consent, the date and time, the email, the account or Order ID, the form's source, the IP address, the user agent, or another technical identifier of the action. The checkbox is never pre-selected; registration or payment can proceed without selecting it.
